1. Agreement to Terms

By accessing or using the Lumae Aesthetics and Wellness website (the "Site") or any of our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not access or use the Site.

These Terms constitute a legally binding agreement between you and Lumae Aesthetics and Wellness ("Lumae," "we," "us," or "our"), a medical aesthetics and wellness practice located on Budde Road in Spring, Texas, operating under the medical direction of Dr. Rahimi, MD.

2. Use of This Website

You agree to use this Site only for lawful purposes and in a manner consistent with all applicable local, state, and federal laws and regulations. You agree not to:

• Use the Site in any way that violates applicable law or regulation;
• Transmit any unsolicited or unauthorized advertising or promotional material;
• Introduce any viruses, malware, or other harmful code to the Site;
• Attempt to gain unauthorized access to any part of the Site or its related systems;
• Reproduce, duplicate, copy, sell, or exploit any part of the Site without our express written permission; or
• Use automated means (bots, scrapers) to access or collect data from the Site without our prior written consent.

We reserve the right to terminate or restrict your access to the Site at any time and for any reason without notice.

3. Medical Disclaimer

All clinical services offered by Lumae Aesthetics and Wellness — including IV hydration therapy, aesthetic injections, ketamine infusion therapy, and telehealth consultations — are provided under the supervision and medical direction of Dr. Rahimi, MD, a licensed physician in the State of Texas. Services are subject to individual patient eligibility, contraindications, and the clinical judgment of Dr. Rahimi or the treating licensed professional.

Results from any of our services may vary among individuals. We make no guarantees regarding specific outcomes of any treatment or program. Before beginning any treatment, all patients must complete a medical intake and evaluation process.

In an emergency, call 911 or go to your nearest emergency room. This website is not a substitute for emergency medical care.

4. Telehealth Services

Lumae Aesthetics and Wellness offers telehealth consultations with Dr. Rahimi, MD for patients located in Texas. By requesting or participating in a telehealth consultation, you acknowledge and agree that:

• Telehealth is not appropriate for emergency medical situations;
• You are located in the State of Texas at the time of the consultation;
• A valid physician-patient relationship will be established prior to any prescription being issued;
• Dr. Rahimi retains full clinical authority over all prescribing decisions and may decline to prescribe based on clinical judgment;
• All GLP-1 and compounded medications prescribed are for your personal use only and may not be transferred to another person; and
• Video consultations are conducted via Doxy.me, a HIPAA-compliant platform. You consent to the use of this platform for your consultation.

5. Appointment, Cancellation & Refund Policy

Scheduling

Appointments are scheduled through our online booking platform (Vagaro) or by contacting our clinic directly. Availability is subject to change. A booking confirmation is required for your appointment to be secured.

Cancellation & Rescheduling

We require a minimum of 24 hours' notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours' notice or failure to appear for a scheduled appointment may result in a cancellation fee. Please contact us as early as possible if you need to make changes to your appointment.

Refunds

Consultation and treatment fees are generally non-refundable once a service has been rendered. If you have a concern about a service you received, please contact us directly. Prepaid package balances may be credited toward future services at our discretion. Unused portions of annual telehealth subscriptions are non-refundable after the initial evaluation has been completed.

Membership

Wellness memberships are billed monthly on a recurring basis. Members may cancel their membership at any time with 30 days' written notice. Monthly benefits expire at the end of each billing period and do not roll over.

6. Pricing

All prices displayed on this Site are estimates and are subject to change without notice. Final pricing may vary based on your individual treatment plan, selected add-ons, and applicable state or local requirements. Pricing for telehealth programs may vary based on the medications prescribed and pharmacy availability.

7. Intellectual Property

All content on this Site — including text, graphics, logos, images, icons, and software — is the property of Lumae Aesthetics and Wellness or its content licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works of any content on this Site without our express written permission.

The Lumae Aesthetics and Wellness name, logo, and all related marks are trademarks of Lumae Aesthetics and Wellness. Use of these marks without our prior written consent is prohibited.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Lumae Aesthetics and Wellness, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of this Site or our services, including but not limited to loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under or related to these Terms or your use of our Site or services shall not exceed the amount paid by you to Lumae Aesthetics and Wellness in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lumae Aesthetics and Wellness and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Disclaimer of Warranties

This Site and its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

This Site may contain links to third-party websites or services (such as Vagaro for booking or Doxy.me for telehealth). These links are provided for your convenience only. 12. Governing Law and Dispute Resolution

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you hereby consent to the personal jurisdiction of those courts.

Before initiating any formal legal proceeding, you agree to first contact us in good faith and attempt to resolve the dispute informally. If the dispute is not resolved within 30 days of your initial notice, either party may pursue formal legal remedies.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Changes are effective immediately upon posting. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes.
